Terms and Conditions:

RENTAL:

  • Rentals are holiday lets in the terms of the housing (Scotland) Act 1988.
  • Rental periods are weekly, Sat to Sat.
  • Entry to the property is after 4PM on the first day of the rental.
  • Please vacate the property by 10AM at the end of the rental period.

PAYMENT:

  • A booking is considered as provisional until a deposit has been received.
  • A deposit of 20% of the holiday cost is required to be paid within 7 days of booking.
  • The balance of the cost of the holiday must be paid no later than 8 weeks before the start of the holiday. In the event of this proportion of rent not being received by the due date, the owner reserves the right to cancel the let without further notice and without any refund of the deposit already paid.
  • If making a last minute booking, the full cost of the rental must be paid immediately, and in such a way so as to be cleared before start of the holiday.

MISCELLANEOUS:

  • As part of the rental the following are included: Bed linen (one set each bed), Towels.
  • There is no landline, we have found Vodaphone gets a good signal, other providers may vary.
  • There is a permanently open entrance to the driveway in the garden.
  • Children must be supervised at all times.
  • The owners do not accept liability as to the security of the garden enclosure under any circumstances and cannot accept responsibility for the safety of any children.
  • Care must be taken operating the woodburner using gloves provided.
  • Fireguard should not be removed from front of woodburning stove during operation.
  • The property owner shall be allowed access to the holiday accommodation at any reasonable time during any holiday occupancy.
  • Please note - there is no wheelie bin collection at the cottage. Tenants are responsible for taking their own refuse to the collection point at the bottom of the road at A95 junction.
  • Windows and doors must be locked when cottage is unoccupied.
  • The cottage has a private filtered water supply and is therfore advisable to boil water before drinking. Please run the cold water taps for several minutes prior to using.

  • Please note also that the water pressure is quite low due to the private water supply.

LOSS OR DAMAGE TO THE PROPERTY OR CONTENTS:

  • The cottage should be left in a clean and tidy condition at the end of the holiday period. A refundable damage deposit may sometimes be required.
  • Any loss or damage to the house or its contents during your stay must be reported to the owners.
  • We reserve the right to make a claim against you should any damage be caused to the house or its contents.
  • We reserve the right to make a claim against you should any excess cleaning be required.
  • An inventory of contents will be provided on your arrival for you to check contents and condition. please refer any concerns to us on the day of arrival.

PAYMENT OF DAMAGES:

  • If a damages deposit has been requested by the owners and paid by the tenant, the tenant shall be entitled to receive a full refund of the deposit within 7 days of vacating the property. If a claim is made by the owners on the deposit, the owners must notify the tenant, giving details of the claim by any suitable means, (phone, e-mail or letter), within 24 hours of the tenant vacating the property.
  • If the tenant has paid for their rental by credit or debit card, the owners shall be entitled to charge any damages to this card provided that they notify the tenant, giving details of the claim, by any suitable means, (phone, e-mail or letter), within 24 hours of the tenant vacating the property.

LIABILITY:

Please make sure that you have adequate insurance to cover any eventualities. The owners cannot be held liable for the following:

  • Weather conditions that prevent access to the house, and consequences thereof.
  • Utility failure to supply power or water.
  • Loss of or damage to the tenant's (holidaymakers) property.
  • Injury to any member of the tenant's (holidaymakers) party.

RESTRICTIONS:

  • No pets allowed within the property.
  • No smoking anywhere in the property.
  • We reserve the right to make an additional charge for cleaning should there be any evidence of smoking during a rental period, and will charge for any consequential damage as a result of smoking at cost.
  • Occupancy: No persons other than those set out in the booking form shall be permitted to occupy the property. Occupancy must not exceed the maximum stated number on the website or advertising.

 FUEL OIL AND ELECTRICITY:

  • The cost of fuel oil and electricity are included in the price of the rental. A free supply of logs for the woodburner will also be available.
  • Please note we reserve the right to make an additional charge for electricity used in excess of 70KW per week. The cost of reasonable usage of electricity is included in the rental. Please do not use high energy consumption items such as electric fires or electric blankets.

CANCELLATIONS AND REFUNDS:

  • All cancellations must be notified to the owners before the holiday commences. Cancellations more than 3 months before entry date will be refunded in full less a £20 administration charge.
  • Cancellations between 6 weeks and 3 months before entry date will be refunded the rental fee (if already paid in full) but retain the 20% deposit.
  • Cancellations less than 6 weeks before entry date will not be refunded, however if the cancellation is re-let, the owners will refund the rental but retain the 20% deposit.
  • In the event, due to unforeseen circumstances, the cottage is not available at the time of occupation, the owner shall only be liable to refund the holiday tenant the monies received at that date. Liability shall not in any circumstances exceed this refund.
  • The owners strongly recommend clients take out a suitable insurance policy to cover the cost of cancellation of your holiday by you for any reason.
  • If tenants breach any of the terms and conditions the owners reserve the right to re-enter the property and terminate the tenancy with immediate effect.
